Animal Rescue Participation Agreement
Release & Indemnification

This Agreement is entered into by ______ (“Rescue”) and Malibu Farmers Market / Cornucopia Foundation (“Market”) for participation in Market events.

1. Responsibility for Animals

Rescue is solely responsible for all animals brought to the Market and for all actions of its volunteers, representatives, and agents. All animals must remain under direct supervision at all times and may not be left unattended.

2. Assumption of Risk

Rescue acknowledges that public events involving animals carry inherent risks, including but not limited to dog bites, scratches, attacks, escape incidents, and injury or property damage. Rescue assumes full responsibility for these risks.

3. Release of Liability

To the fullest extent permitted by law, Rescue releases and discharges:

Cornucopia Foundation
City of Malibu
County of Los Angeles
Their officers, directors, employees, volunteers, and agents

from any claims arising out of Rescue's participation or animals under its care. This release does not apply to gross negligence or willful misconduct.

4. Indemnification

Rescue agrees to indemnify, defend, and hold harmless the above entities from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

Injury to persons
Property damage
Animal-related incidents
Acts or omissions of Rescue or its representatives

5. Insurance

Rescue must maintain Commercial General Liability Insurance covering animal-related incidents and event participation. A current Certificate of Insurance must be provided listing as Additional Insured:

Participation is contingent upon maintaining active insurance coverage.

Acknowledgment — Rescue acknowledges that it has read and agrees to the terms of this Agreement.
